Children and teenagers in the United States are still being sentenced to die in prison. Youth under the age of 18 can receive life sentences, including life without the possibility of parole (in 11 states, this can happen as young as 8 years old).

In 2012, the U.S. Supreme Court ruled in Miller v. Alabama that mandatory life‑without‑parole sentences for juveniles are unconstitutional because they violate the Eighth Amendment’s prohibition on cruel and unusual punishment. The Court left open the possibility that judges may still impose discretionary life without parole on youth convicted of homicide, but only after considering age, trauma, and other mitigating factors.sentencingproject+1

Even after Miller and related decisions, the United States remains the only country in the world that still sentences people to life without parole for crimes committed before age 18.

How many children and former children are serving life?

When Miller was decided, about 2,800 people were serving juvenile life without parole (JLWOP) for crimes they committed as minors. A 2016 snapshot put the number of children and juveniles serving JLWOP at roughly 2,310.[original text] Since then, resentencings and reforms have reduced that population: more than 900 individuals previously condemned to die in prison as juveniles have now been released, often after decades behind bars.

But JLWOP is only the tip of the iceberg.

  • As of 2023, one major national analysis found that 1 in 6 people in U.S. prisons, nearly 200,000 people, are serving some form of life sentence (LWOP, life with parole, or “virtual life” terms of 50+ years).
  • A significant share of those life sentences were imposed for crimes committed while the person was under 18 or in their late teens and early twenties.
  • Beyond JLWOP, thousands of people are serving life with parole for crimes committed as juveniles; estimates in the early 2020s put that number at over 7,000 nationwide.[original text] These “life with parole” terms often require 25–50 years before the first parole hearing, functioning as de facto life sentences for many.

In 2021, there were still around 300 children and juveniles incarcerated in adult prisons after being prosecuted as adults. The U.S. has reduced the number of children charged as adults from over 250,000 per year in the early 2000s to about 53,000 today, but that is still an enormous pipeline of children into adult systems that were never designed for them.

A key multistate study (based on 2014 data, still the most detailed breakdown of adult‑court filings) found.

  • Across 23 states, there were 37,941 youth cases filed in adult court in the year studied.

  • Of the 23,553 cases they could fully trace, 15,410 (about two‑thirds) came from just three states: Michigan, North Carolina, and Florida.

  • Florida remains a standout; over just five years, 4,446 children were charged as adults, more than any other state, largely via prosecutor “direct file.

  • Michigan and North Carolina also continue to appear as heavy users of transfer/auto‑charge relative to their youth populations.

Who can be tried as an adult, and how young?

Today, 11 states, Alaska, Florida, Hawaii, Idaho, Maine, Michigan, Pennsylvania, Rhode Island, South Carolina, Tennessee, and West Virginia, have no minimum age specified in law for trying a child as an adult. Children as young as eight have been, and can be, charged as adults in some of these states.

At the same time, some states are moving in the opposite direction. In 2023, Massachusetts became a pioneering state court jurisdiction to prohibit life without parole for “emerging adults” ages 18–20, and in 2024–2025, Hawaii passed a law banning life without parole for anyone who was under 21 at the time of the offense. Hawaii also set a minimum age of 12 for juvenile court jurisdiction, recognizing that very young children should not be pulled into criminal courts at all.

Some states raising protections for youth and emerging adults, others retaining or expanding harsh sentencing, mean that a child’s fate can depend heavily on the state line they happen to cross.

Supreme Court rulings: progress and pushback

Over the past two decades, the Supreme Court has issued a series of decisions that acknowledge a basic truth: children are different” for purposes of criminal punishment.

Key cases include:

  • Roper v. Simmons (2005): Banned the death penalty for crimes committed under age 18.
  • Graham v. Florida (2010): Banned life without parole for juveniles convicted of non‑homicide offenses.law.
  • Miller v. Alabama (2012): Banned mandatory life without parole for juveniles in homicide cases; judges must consider youth and mitigating factors.
  • Montgomery v. Louisiana (2016): Made Miller retroactive, leading to resentencing and releases for many people who had been sentenced to JLWOP as children.
  • Jones v. Mississippi (2021): Pulled back, holding that judges do not need to make a specific finding that a youth is “permanently incorrigible” before imposing life without parole, so long as they had discretion and considered age.pbs+1

Advocates argue that Jones makes it easier again to sentence minors to life without parole despite the science of adolescent brain development and trauma.

Real stories: kids sentenced to die in prison

Behind every statistic is a child whose brain, life circumstances, and environment made them especially vulnerable to terrible decisions.

  • In Michigan, Dakotah Eliason was sentenced to life without parole for killing his grandfather at age 14; his case helped highlight Miller’s impact and the question of whether mandatory JLWOP can ever be just.newyorker
  • In a Florida case, Joe Sullivan was 13 when he was sentenced to life without parole for a non‑homicide sexual assault; he was one of only two known 13‑year‑olds in the country given JLWOP for a non‑homicide crime at that time.law.nyu+1

These stories are not outliers, they reveal how trauma, poverty, and lack of support intersect with harsh laws to produce sentences that write off a child’s entire future.

What adult prisons do to children

Prisons are dangerous places for young people. Children in adult prisons are raped and beaten at 3 to 5 times the rate of adults, according to multiple advocacy and government sources. To “protect” them, facilities often resort to solitary confinement, putting kids alone in cells for 22–23 hours a day, an approach that is extremely traumatizing and associated with lasting mental illness, self‑harm, and suicide.

Adult prisons almost never provide what children need to grow and change:

  • Education tailored to adolescents
  • Age‑appropriate mental health treatment for trauma, depression, and PTSD
  • Rehabilitative programming focused on development, not warehousing

Studies following youth who were incarcerated as adults show they have significantly worse physical and mental health outcomes decades later than similar youth processed through juvenile systems, higher rates of hypertension, obesity, functional limitations, and serious psychiatric disorders.

Recidivism: we are creating more crime, not less

Youth prosecuted as adults have higher rates of re‑arrest and reincarceration than youth kept in juvenile courts, even when controlling for offense type and prior record. Adult prisons harden kids, deepen trauma, and surround them with older people skilled in violence and crime. The cost of these practices is enormous. The return on investment from early childhood and redirecting youth to healing and skill building

Meanwhile, America as a whole has sustained a nine‑year recidivism rate around 80% for people leaving prison, meaning roughly 4 out of 5 will be re‑arrested within nine years. This is not just a moral failure; it is a practical disaster in terms of public safety and cost.

None of this suggests that you, I, or our nation benefits from institutions that create more discrimination, broken people, crime, and criminals.

Racial injustice: which kids are punished most harshly?

Youth of color, especially Black children, are disproportionately:

  • Charged as adults
  • Given extreme sentences (including JLWOP and de facto life terms)
  • Confined in the harshest adult‑system environments

This happens even when the underlying conduct is similar to that of white youth. These disparities are not an accident; they reflect generations of unequal policing, prosecution, and resource allocation.

Trauma, toxic homes, and the “poor child to felon” pipeline

Minnesota Supreme Court Chief Justice Kathleen Blatz famously said,

“The difference between that poor child and a felon is about eight years.”

She was describing what every experienced child advocate sees: children raised in toxic homes, exposed to untreated trauma, are on a short and predictable path from victim to defendant. Childhood trauma changes brain development, impulse control, and emotional regulation. If left untreated, it becomes mental illness, substance use, and behavior problems that can last a lifetime.

But economically, socially, and morally, we all lose when children are left without a community willing to pull them out of toxic homes and into healing, treatment, and skill‑building.

Signs of hope: reform and resistance

There are concrete signs of progress:

  • 25 states and D.C. now ban juvenile life without parole, and another 7 states have no youth currently serving JLWOP, effectively abandoning the sentence.
  • States like Massachusetts and Hawaii are extending protections into the early twenties, recognizing “emerging adults” as developmentally closer to youth than older adults.
  • The U.S. Justice Department has invested more than $130 million in recent years to support youth violence prevention, juvenile system reform, mentoring, and reentry programs across the country.

But these reforms are uneven, often fragile, and sometimes under attack. The mix of articles and reports gathered here offers only a snapshot of what is happening across the nation in juvenile justice, and what is at stake if we fail to see abused, traumatized children as children first.
